General Ben & Penny Hanson are referred to as ‘the Owners’. Clients applying to hire Villa Delphia are referred to as ‘the Applicants’ until such time as they take up residence when they are referred to as ‘the Tenants’. Villa Delphia is referred to as ‘the Property’. ‘Rent’ means the weekly payment to be paid for renting Villa Delphia.

Booking Applicants are advised to check availability on the web site.The owners will send the applicants a booking and terms and conditions for completion and signing. The booking form and terms and conditions should be retuned with either the deposit or the full rent if the booking is made less than 6 weeks from the date of the holiday. Bookings will only be deemed to be accepted when made in writing on the owners booking form and signed by one of the applicants and accompanied by a cheque for the deposit or full rent as applicable. Telephone reservations are not regarded as bookings until the above booking conditions have been complied with.

Deposit A non returnable deposit of £200 per week booked is payable on booking. If a booking is made 6 weeks or less before arrival the full rent is due at the time of the booking.

Final Payment A final invoice will normally be sent to the applicants 8 weeks before the date of their holiday. Payment must be made in full 6 weeks prior to arrival date. Non payment by that date will be treated as a cancellation and the owners may relet the property without reference to the applicants who remain liable for the full amount although credit will be given for any rents received as a result of reletting, less the owners expenses.The same will apply to a cancellation within 6 weeks of arrival date.

Security deposit A security deposit of £200 is charged at the time the balance of the rent is paid, to cover damage and breakages which will be refundable within 14 days of the vacation of the property as long as no damage has been incurred. If there has been damage or breakages the amount for repair will be deducted from the security deposit and if the damage be more than the security deposit the tenants will be liable.

Cancellation Insurance Applicants are recommended to take out holiday cancellation insurance.

Price changes The Owners reserve the right to amend prices quoted on the website due to errors or omissions.

Method of payment Payments are to be made by cheque made payable to Ben & Penny Hanson. Do not send cash. Post dated cheques are not acceptable. Any charges raised against the owners by their bank for handling dishonoured cheques will be passed on to the applicants.

The Tenancy The tenancy confers upon the tenants the right to occupy the property for a holiday within the meaning of Schedule 1, Paragraph 9 of the Housing Act 1988.

Tenants’ Obligations
  1. To pay for any losses or damage to the property. All breakages are to be reported to the owners or owners representatives and will be paid for at replacement cost .
  2. To take good care of the villa and to leave it in a clean and tidy condition at the end of the tenancy. Cleaning is not provided during the tenancy unless otherwise arranged with the owners.
  3. To permit the owners or their representatives reasonable access to the property for pool cleaning etc..
  4. Not to part with possession of the property or share it, except with members of the party shown on the booking form.
  5. Not to exceed the total number of people stipulated on the booking form.
  6. Not to cause annoyance or become a nuisance to occupants of adjoining premises.
  7. There will be no charge for electricity unless, in the unlikely event consumption exceeds £50 pw.

Duration & Times of Letting Lettings are for a maximum of 4 weeks and commence at 4.00pm on the first day of tenancy and end at 10.00 am on the last day of tenancy unless otherwise agreed by the owners.

If for any reason beyond the owners control the property is not available on the date booked (owing to fire damage for example), or is unsuitable for holiday letting, unless the owners offer the applicants a property of equivalent size and quality or better on the original terms, all rents and charges paid in advance by the applicants will be refunded in full, but the applicant shall have no further claim against the owners.

Complaints It is important that the tenant has an enjoyable holiday at Villa Delphia, however in the unlikely event of a complaint or problem, the tenant must advise the owner or owners representative immediately, so that a fair opportunity is given to rectify any difficulties. No liability for any subsequent claim will be accepted on return from the holiday.

Towels Towels are provided for use by the pool,but must not be taken off the premises, towels for use on the beach need to be brought by the tenant.

Website Information The information contained in the Villa Delphia website is believed to be accurate. Whilst the owner takes reasonable steps to ensure accuracy, they cannot accept responsibility for errors contained in the website or the result thereof. The tenant must accept that minor differences between text & photographs and actual property may arise. All distances& times quoted are approximate and relate to travel by car.

Breach of Contract If there shall be a breach of contract of any of these conditions the owner or owners representative reserve the right to re-enter the property and terminate the tenancy, without prejudice to all other rights and remedies of the owner.

Law of Contract The law governing the contract between the owner and the applicant/tenant shall be the law of England .

Authority to sign The person who signs the booking form certifies that he or she is authorised to agree to these conditions on behalf of all persons included on the booking form, including those substituted or added at a later date. The signatory must be a member of the party intending to occupy Villa Delphia and be over the age of eighteen years.
